Our highly experienced team can assist the elderly and their families with:

  • Wills & Probate
Joseph Trimarchi and Associates will guide you through the range of issues that need to be considered when deciding who will receive your assets upon the Execution of your Will. We will assist you in setting up executors and all matters regarding Will creation.
  • Power of Attorney
If you lose your capacity to handle your own affairs, an Enduring Power of Attorney can really help your loved ones make decisions on your behalf. An Enduring Power of Attorney is an invaluable way of ensuring your affairs are being handled by a trusted person in the event that you become ill or lose your legal capacity.
  • Retirement Planning
Retirement Planning also referred to as Estate and Succession Planning is the process of planning for the efficient transfer of a person’s assets after they pass away. Our team are experienced in preparing the various legal documents required and will assess your situation in-depth to formulate an appropriate planning strategy.
  • Enduring Guardianship
An Enduring Power of Guardianship specifically empowers your nominated ‘guardian’ to make lifestyle, health and welfare decisions for you such as deciding where you might live or what medical treatment you should receive if you’re unable to make these decisions for yourself. While an Enduring Power of Attorney is your empowered ‘attorney’ granted authority over financial affairs, a Guardian is not authorised to make financial decisions. However, a person can be appointed as both a Guardian and a Financial Manager.
  • Advanced Care Directives
An Advanced Care Directive (ACD) is a legal document allowing you to set out your wishes for your future care and treatment should you become ill. Advanced Care Directives can come into effect when you’re unable to make reasonable judgments and or decisions about your own health treatment.
  • Retirement Living & Accommodation
Moving into an assisted living community or a retirement village can be a complex and challenging process that is difficult to navigate. It is important to get the right advice on aged care accommodation options so you can understand your financial obligations and what living in these types of communities means for you.
  • Disputes arising from the estate
The validity of a Will is determined by basic requirements, but sometimes a Will gets challenged. Our team at Joseph Trimarchi and Associates have expertise in knowing what evidence is required to successfully validate a Will and are experienced in the procedures that follow.

We Understand Elder Law
As we are living longer than ever before, it is essential that the needs and rights of our beloved elderly are provided for and protected.

The decisions we’re faced with as we grow older can impact our quality of life, dignity, financial security and relationships. While arguably some of these decisions are straight forward, others are complex and can often require specific legal advice and knowledge of Elder Law.

Our experienced team is here to help. We can provide you with expert legal advice, guidance and assistance with all matters relating to Elder Law. Joseph Trimarchi and Associates are all about protecting the elderly. It is our primary focus. Whether you are elderly, or you are giving care and support to an older person, there are essential legal arrangements for you both to consider. Putting measures in place to prepare for the later years can make all the difference in retiring with dignity and security.

One such measure that should be put in place is your Will. It’s important to remember that what you say in your Last Will is the last thing you get to say to your loved ones. It is the final way that you can help them while taking comfort in knowing they’re provided for in a way that reflects your wishes.

Besides Wills and Probate, Elder Law includes many other legal aspects of elderly life. Elder Law addresses such matters as;

  • Loss of Capacity and Advanced Care Directives
  • The preparation of Wills, Enduring Guardian and Enduring Power of Attorney documents
  • Probate and Administration
  • Superannuation Entitlement Claims
  • Misuse of Enduring Powers of Attorney
  • Financial Abuse of the Elderly
  • Retirement Village and Nursing Home Accommodation (aged care entry, legal advice and contracts)
  • Family Trusts
  • Estate Disputes
  • Administration and Guardianship Applications
  • Lodging caveats to protect an older person’s property
  • Assisting revoking signatory arrangements at banks
  • Making applications to the Court
  • Granny Flat Agreements
  • Retirement Planning
  • Home equity schemes and reverse mortgages
  • Family Law Matters including the rights of Grandparents
  • Decisions relating to a person’s mental and physical health and healthcare

The legal issues surrounding the decisions mentioned above are unique to the ageing and elderly. Our legal team are equipped with the expertise and experience in all aspects of Elder Law. Joseph Trimarchi and Associates can provide you with personalised and clear advice, tailored specifically to your needs.

Whether this is needed for you or someone you care about, we can help you plan for your retirement or assist you in planning for your loved ones who no longer have the capacity to do so.

Although knowing the law is essential, it is important that our clients feel respected and supported knowing we’re there to walk beside them each step of the way. We operate with the highest level of integrity and will take the time to address and explain the implications of any decisions you make regarding your future.

Our expert team is here to help you navigate all aspects of Elder Law as we endeavour to fulfil our mantra – “Providing Peace of Mind and Certainty for the Seniors of NSW.”
